These Terms govern your use of Charta Visa. Read them once — most matter only if something goes wrong. The Plain-English Summary at the bottom restates the parts that bind both of us.
By using Charta Visa, you accept these Terms.
Creating an account, paying, or submitting an application counts as acceptance. You also accept our Privacy Policy and Refund Policy, which are incorporated here by reference. If you don't accept any of these, do not use the service.
You are 18 or older and have the legal capacity to enter into a binding contract in your jurisdiction. You are not on any U.S., EU, UN, or UK sanctions list. You may submit an application on behalf of a minor in your legal care or another adult who has given you express authorization — and you accept these Terms on their behalf.
Section: eligibilityCharta Visa provides a guided application wizard, automated and human review against common rejection causes, and direct submission to the issuing government portal on your behalf. We confirm receipt and track status until a decision is issued.
Section: scope of serviceCharta Visa is not a government, embassy, consulate, or law firm. We do not decide whether your travel authorization is approved or denied — that decision belongs solely to the issuing authority. We do not control processing times. We do not control entry decisions made by border officers. We do not provide legal or immigration advice.
Section: limits of serviceYou provide accurate, current, and complete information. You do not impersonate another person. You do not submit forged, altered, or third-party documents without authorization. You keep your password confidential and are responsible for activity on your account. You comply with all laws applicable to your travel and your application.
Section: your obligationsOur service fee is $39 USD per traveler per application. The issuing government also charges its own non-negotiable processing fee, which varies by authority (for example: ETIAS €20, ESTA $21, UK ETA £16). Government fees are collected and remitted to the authority — we do not keep them. Payments are processed by Stripe in USD; non-USD prices shown are estimated conversions and may differ from the final card charge.
Section: pricingOur service fee is refundable in the scenarios described in our Refund Policy. Government fees are never refundable by Charta Visa — once submitted, they belong to the issuing authority and are governed by that authority's rules.
Section: refunds — see refund policyThe Charta Visa name, logo, software, screens, and content are owned by Charta Labs, LLC and protected by U.S. and international intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the service for its intended purpose. Your personal data and uploaded documents remain yours; you grant us a limited licence to process them only to the extent needed to deliver the service.
Section: IPYou may not: (a) provide false or misleading information; (b) forge, alter, or use documents that do not belong to you; (c) attempt to evade sanctions, bans, or government decisions; (d) scrape, reverse engineer, or interfere with the service; (e) resell or sublicense the service without our written consent; (f) abuse our staff. We may suspend or terminate access at any time for any of these.
Section: prohibited conductYou may close your account at any time from the dashboard. We may suspend or terminate access immediately if you breach these Terms, submit fraudulent information, become subject to sanctions, or remain inactive for more than 24 months. On termination we delete your account per the Privacy Policy, except where law requires retention.
Section: ending the agreementTO THE FULLEST EXTENT PERMITTED BY LAW, Charta Labs, LLC's total liability for any claim arising out of or relating to the service is capped at the greater of (a) the service fee you actually paid for the disputed application, or (b) $100 USD. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost travel cost, missed flights or events, lost profits, lost data, or substitute service cost — even if foreseeable. Government fees paid to issuing authorities are not refundable by us and are not part of this cap.
Section: liability capYou will defend, indemnify, and hold harmless Charta Labs, LLC and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your provision of false, misleading, or unlawful information; (c) your violation of any law or third-party right; or (d) any government decision made about you. We retain the right to control the defence of any claim we are indemnified against.
Section: indemnityThe service is provided AS IS and AS AVAILABLE, without warranty of any kind — express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant approval of any application, any specific processing time, or that the service will be error-free.
Section: disclaimer of warrantiesNeither party is liable for failure or delay caused by events beyond reasonable control: government action, war, sanctions, embargoes, civil unrest, pandemics, natural disasters, cyber-attacks on critical infrastructure, internet or government-portal outages, or labor disputes. We will resume performance as soon as the event ends.
Section: force majeureThese Terms and any dispute arising from them are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. Applicable U.S. federal law also applies where preempted. EU and UK consumers retain the mandatory protections of their home jurisdictions; nothing here limits a right that local law makes non-waivable.
Section: governing lawStep 1 — Before filing anything, write to legal@chartavisa.com describing the dispute. We have 30 days of good-faith negotiation to resolve it. Step 2 — Any unresolved dispute is settled by individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in New York County, USA, in English. The arbitrator's decision is final. Step 3 — Class-action waiver: claims must be brought individually. No class, collective, or representative actions. Step 4 — Carve-out: either party may bring a qualifying claim in small-claims court in New York County. Step 5 — Opt-out: you may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@chartavisa.com with "Arbitration Opt-Out" in the subject; doing so does not affect any other part of these Terms.
Section: dispute resolutionWe may update these Terms. Material changes — those that meaningfully reduce your rights or expand our rights — are notified by email at least 30 days before they take effect. Non-material changes (typos, restructuring, examples) may take effect immediately and be flagged in the version log. Continued use of the service after the effective date is acceptance.
Section: amendmentsSeverability: if any clause is unenforceable, the rest stays in force. Waiver: not enforcing a right once is not waiving it. Assignment: you may not assign these Terms; we may assign them in a merger, acquisition, or restructuring. Entire agreement: these Terms together with the Privacy Policy and Refund Policy are the entire agreement between you and Charta Labs, LLC, superseding any prior agreement. Notices to us must be in English and sent to legal@chartavisa.com.
